building this afternoon and made sure that there wasn't any damage inside and that doors and windows were locked, they have not so far taken anylhycasi action to physically remove the parents or their tents. >> sleeping bags and then we talked with the lights. and we just talk about our day. >> reporter: it's not exactly the summer camp-out the velazquez children envisioned. for the past three nights, they have been camping out on the grounds of lakeview elementary. a last-ditch attempt to save the school from closure. >> obviously, it's political. but we've had fun. it's been a wonderful vibe. we have parents and teachers and students hanging out and taking back public education. >> reporter: but the camp-out took a new twist this morning when oakland school police showed up and posted warnings that protesters are breaking the law. just as the family and supporters entered the building and started up a so-called

children's summer program. >> they raises a number of issues where you have people with the ability to potentially fortify themselves inside the building. we have see the if we can come to some is negotiated resolution. and if not, then we will have to take action, sooner than later. >> reporter: but the families are get agroing number of backers. members of the occupy oakland movement are now helping to rally support. >> for normal people to have children, they have things to lose, to actually take a stand is very commendable and it's very brave. >> reporter: the velazquez family is determined to stick it out. they say far too many school closures are taking place across the country, and it's time to act. >> and it's been worth it. this is why we're here. life is too short. you have to either stand up for something or don't bother living. >> i love my children. and what i see has happened to these families across oakland is not okay. >> reporter: and we are back here live. you're looking at the top of one of the tents that is pitched out

here. there are actually nine tents pitched in front of the school and these families, and their supporters do intend to camp out here. things have ramped up. the police have taken a number of actions today, posting those warnings. and just a short time ago, touring the school. the district spokesperson says that they are monitoring this hour by hour. they say it's a very fluid situation, and they say this cannot go on indefinitely. at some point they will remove the parents. but so far no action as of yet. and the parents remain steadfast to stay out here and do what they can to keep school open. reporting live in oakland, i'm jodi hernandez, nbc bay area news. >> let's hope it stays a safe situation. thank you, jodi. in about half hour school leaders in allen brock will get an earful. the families have children and elementary school, and they're calling on school officials to do more to serve the needs of the nearly 13,000 kids in that district. among their biggest requests,

they want charter schools, more of them, a promise that any money raised through a proposed bond measure will be distributed equitably. and they want more stability. >> i felt like the charter schools have given us that extra push. however, some of the kids in our neighborhood have been left behind. so it's not a good feeling. >> we've had good gains over the last several years. several of our schools have some of the best in the county. that doesn't mean that we're not aware that parents want us to do more. >> parents are meeting at the mayfair community center this evening at 6:30. the interim superintendent says he will be there. an east bay couple is in jail tonight after investigators say they stole hundreds of credit card numbers and went on a shopping spree. authorities arrested otis hickman and jazmine cooper yesterday morning early uin carmel after a collection of

allegedly cloned credit cards were found during a search of hickman's car. they say the couple admitted to using the credit cards to purchase more than $500 worth of merchandise over a three-hour period. contra costa sheriff's deputies then searched the couple's bay point home and found hundreds more cloned credit cards. investigators say there could be as many as 500 victims with hundreds of thousands of dollars in losses. he has worked with vulnerable children for years, but now he is accused of molesting at least three of them. and police fear in los gatos there may be other victims. investigators say 33-year-old bailey sexually molested two young girls in his care, as well as an 18-year-old with the developmental abilities of a kindergartner. until he was put on leave last year, bailey worked as a staff member at east field's ming wong. he has worked at a facility for the developmentally disabled in san jose. he was formally charged today. anyone with information on this case is asked to call the police.

a santa rosa father accused of kidnapping his three young daughters appeared in court this afternoon. 25-year-old jose alberto rojo was arraign onca several charges including child endangerment and assault with a deadly weapon. last thursday police say rojo allegedly threatened to hurt his three children and himself during a confrontation with his wife. she has a restraining order against him. he took off with the girls and an amber alert was issued. he later dropped them off at her grandmother's house. they were not hurt. the search for sierra lamar continues tonight with a new search of a reservoir near morgan hill. this time with new equipment. the santa clara dive team will rescan the chesbro reservoir which is three miles west of morgan hill. investigators say the rescan is not based on new tips, but they wanted to search with new side sonar equipment they just acquired. they're hoping to pick up new clues they may have missed. sierra lamar has been missing since march 16th. you may know the reward of the case is now at $35,000.

a 26-year-old oakland manson life support tonight after being shot while driving on an east bay freeway. it happened on 580 near fruitvale avenue in oakland. the man's brother, who was a passenger, was not hurt. but a potential witness. the freeway had to be shut down for several hours for the investigation. police are asking anyone with information to please give them a call, a reward of up to $15,000 is being offered. president president obama's announcement to stop deporting the children of undocumented immigrants is getting praise from mexico's president. president obama met with felipe calderon at the g8 summit in mexico. the president talked with him about the strong bonds that link both nations. >> we believe that this is very just. it's a humanitarian action, and it's an unprecedented action in our opinion. and in this sense, mr. president, we would like to thank you for the valor and courage that you had implementing this action. >> among the criteria for

illegal immigrants, being younger than 30, proving they were brought to the u.s. before they turned 16, and having been in the country for at least five straight years. efforts by government agencies to sensor internet search results seem to be on the rise. the latest transparency report by google finds that in the last half of 2011, u.s. agencies asked the company to remove more than 6,000 pieces of content. that number is up more than 100% compared to the first six months of the year. other governments, including canada, france, and the uk have also increased their requests. mountain view-based google said it did not comply with more than half of the requests. the federal government is expanding its investigation into the fires that can start in the doors of several toyota type vehicles. today the national transportation safety board added 600,000 camrys and various other vehicles from model years 2007 through 2009 to its existing probe. the investigation started back

in february. it now includes nearly 1.5 million toyota vehicles. investigators say power window switches can overheat, sparking electrical fires in the driver's side door. now since launching that probe, toyota says it has received 161 complaints of fires resulting in nine injuries. so far, though, the government agency hasn't initiated a recall. $10 million. that's how much bay area radio giant ralph barbieri wants in a lawsuit against his former employer. the 66-year-old was let go from knbr in april. he claims he was fired because he has parkinson's, type 2 diabetes and because of his age. knbr's parent company says barbieri was fired because he failed to honor the terms of his contract. while the u.s. open is officially in the books, and once again olympic club's course produced a lot of drama and an unlikely winner. 26-year-old webb simpson came from behind to win the 112th u.s. open. simpson never led in the tournament until after his final shot of the day.

watching every step of the way, and we do mean every step, was his wife dowd. believe it or not, she is 7 1/2 months pregnant and she walked all 18 holes yesterday to watch her husband make history. well, the u.s. open may be over, but golf fans are still flocking to the olympic club. today they're hunting for great deals of merchandise that has been left behind. prices are right, but the selection is a little limited. during the four-day tournament, the club sold 100,000 hats and thousands of other items. bargain hunters are trying to get their hands on the shirts, umbrellas, even some giant bouncing golf balls. everything left 50% off. according to one u.s. open official, this year's sales far exceeded expectations. and if you wanted to take something home, you had to be fast. >> things are going so fast. if you walk to one side of a room and come back, you might find an empty shelf. >> but if i hadn't taken all the half prices, it would have been more like $300 and $400 or more. no, i think i did okay. >> now the clothing sale just

the jerry sandusky sexual abuse trial is quickly winding down. jurors could begin their deliberations later this week. >> today, though, testimony focused on the character of the former penn state football coach. as nbc bay area's brian mooar shows us, they tried but failed to have the case thrown out. >> reporter: it's on the fast track, and judge john cleland tells jurors they could begin deliberating as early as thursday. they'll be sequestered until they reach a verdict. the prosecution closed today with a mother of a young man known as victim number 9, who recalled the night her son begged her to pick him up at sandusky's home. >> he is outside without his shoes on, waiting for her. he clearly was afraid to be in that house. that was a very powerful moment for the prosecution. >> reporter: reflecting on the boy's suffering, she said, i just can't imagine. the defense opened with a minor victory. prosecutors dropped a misdemeanor child endangerment

charge, but sandusky still faces 51 more serious counts. the first defense witness was another former penn state coach, richard anderson. he testified he, like sandusky, had showered with young boys, many times. the defense argued that is simply part of football culture. prosecutor asked anderson whether he had ever hugged young boys in the shower or stayed with them in hotel rooms. the coach said no. anderson also testified about grueling workdays and frequent travel. >> one of the coaches described how often a coach for penn state would have to work. and you could imagine they would spend a lot of time in the office, on trips, giving speaking engagements. you can imagine there would be a lot of different times when the coach would have his time very well tied up. >> reporter: the defense argues the timing of the alleged offenses is so vague, sandusky can't offer an alibi. but the judge refused to dismiss the charges. as sandusky was leaving the courthouse, a reporter asked

whether he testified. he didn't answer. brian mooar, nbc news, pennsylvania. a jury has found baseball legend roger clemens not guilty of lying to congress. late this afternoon, clemens arrived at federal court in washington, d.c. to hear the verdict. a jury acquitted him of all charges, including obstruction of justice, making false statements, and perjury. prosecutors claim the pitcher lied to lawmakers in 2008 when he testified that he never used performance-enhancing drugs. the verdict is a huge blow to prosecutors who have spent millions of dollars going after clemens. this is the second time the case has been tried. his first trial ended in a mistrial. controlled explosions in switzerland made for quite a sight today. nearly 70,000 cubic feet of rock, about the size is of a football field, blasted away. the explosion done to clear a railway that has been blocked for nearly two weeks because of a slide. one construction worker died in that incident.

dry conditions and high winds are making it hard for firefighters to battle a wildfire in san diego county tonight. the fire started sunday afternoon and has forced the evacuation of about 150 homes. crews say the fire doubled overnight, burning more than 8,000 acres. about 30% of the fire has been contained, but firefighters worry weather conditions could make it worse. the cause of this fire is still under investigation. well, as crews continue to battle the blaze in southern california, fire departments in the bay area spent today preparing for what is expected to be a difficult and dangerous wildfire season all over the country. emergency responders from across santa clara county began a three-day training center, training today near los gatos. the annual event gives firefighters, police officers, medical volunteers and other emergency crews the chance to practice working together during simulated emergency scenarios. >> when we work together through the mutual aid plan, it makes it so that our practice is how we play. we want to be able to be

coordinated and efficient and use what resources we do have the most efficiently we possibly can. >> the wildfire training runs threw wednesday. it was certainly toasty this weekend. let's bring jeff ranieri in. it's about to change. >> cooling winds offshore helping to moderate numbers. in case you missed it on saturday, one of our hottest was livermore at 106. gilroy at 102. and san jose 98. that of course was big news this past weekend. now that onshore flow has returned, somewhat of a fog storm across san francisco through the morning hours with temperatures in the 60s. across the bay, holding on to some more. numbers in the 70s also for the east bay. take you out live to the hd sky camera network on this monday. maybe the fog gave you a little extra boost to get out the door and get going as you headed back to work. it felt very refreshing in downtown san francisco. here is the thing. we'll get rid of the fog for a bit, and then it is going to be sliding back in. for the morning hours, we'll find the patchy fog at the immediate coastline. we'll be warmer here for tuesday. and then this cooling trend into

this upcoming weekend is going to be a stark contrast from what we experienced this past saturday and sunday. right now in the immediate, it's all about this warm tap of air sitting out in the pacific. it's not going to get nearly as hot as it was saturday, and also for sunday. the biggest thing is this is going to switch up our winds. instead of being onshore, we'll find this coming more out of the north and also the northwest. that will bring us 60s and 70s near the coastline. definitely not record setting. a little down sloping wind will provide and make for some 80s and potentially a few 90s. and here is the thing. it's not going to last long. as we head into wednesday, we'll start to get this foggy breeze returning back into the mix to help to drop our temperatures. as far as the fog guess for tuesday, those early commuters at 6:00 a.m. will find fog here across the san francisco peninsula. also the immediate coastline down to santa cruz. watch as we head throughout the day with the drying and warming north winds. it's going to clear out. smooth sailing across tupper coastline, expecting sunny skies for us. we'll begin with 49 in santa

rosa. 51 in napa. a bit of a chill into fremont with 54. 53 in los gatos and 50 in santa cruz. how about the daytime highs? we talked about our warm-up with the dryer wind. it will get up here, but it's only slightly above average with 87 in san jose. 86 in milpitas. 83 in palo alto. and also 89 in sunnyvale. for the east bay, close to 90 in blackhawk, 91 in pleasanton. 90 in dublin. close to 90 in fairfield. and for the peninsula, we'll be at 70 in san francisco. warmer over to oakland with 76. 74 in berkeley. 85 in santa rosa. and a mix of 60s here throughout our coastline. on your three-day forecast, here is what you want to focus in on. as we head through the next two days, there is our warming trend. low 90s inland. and then yes, by thursday, mid-70s. a huge drop-off in the numbers. not only the onshore flow and the fog coming back, but that cooler air aloft will just basically compound things and give us a, well, cool blast here for summer is. look at this.

a professional tennis player is being investigated for assault after kicking an advertising board during a match and injuring a line judge. dave threw a tantrum during a match yesterday in london. he reacted by kicking a board near the line judge. the board splintered and hit the judge's left leg, which started

bleeding. after a long discussion, tournament officials awarded the match to nalbandian's opponent. nalbandian was fined over $12,000 and is now being investigated by police. he apologized after the match saying, quote, i feel sorry for the guy. sometimes you cannot control the moment. well, it is not every day that someone can say they ran with the olympic torch and proposed to their girlfriend the same day. david stake can, though, there he is. with his olympic torch, he put hands it to the guard and on one knee he proposes to his girlfriend, christine. she is wearing that uk outfit, very patriotic. she is also eight months pregnant. she said yes. after hearing the yes, david got a few kisses and grabbed the torch and of course continued running his part of the relay. very nice. now you can see that same flame officially start the summer olympics in just 38 days. all the action will be right here on nbc bay area, and the network of nbc. >> he should get a gold medal for that performance. well,ilestone birthday being celebrated today.

sir paul mccartney, they say it's your birthday. today the former beatle turns 70, if you can believe it. >> mccartney celebrated in private today, perhaps getting some rest in between some of the biggest gigs he has lined up for the summer. earlier this month you may remember he rocked the stage at queen elizabeth's diamond jubilee concert. next month another big show in london. mccartney is the final act at the opening ceremony of the summer games. >> he makes 70 look good. wow. he is still rocking. >> hard to believe. >> let's get a check of our forecast. >> well, believe it or not. >> final forecast. >> we have some 70s coming our way in the seven-day forecast after 90s and triple-digits this past weekend. it will stay more on the hot side tuesday and wednesday.

and then as we head throughout thursday and friday, not only the fog coming back, but also some cooler air aloft will stay dry, but even into the upcoming weekend, temperatures are expected to stay in the 70s inland, and a cool breeze at the coastline with plenty of 60s. so if you i don't like the hot weather the next two days for you, if you want spring back, well, most of the seven-day forecast is going to be enjoyable. >> jeff, a serious meteorological question, which i rarely ask. my questions are usually silly. we've had such a strange pattern, where every time we enter a season it seems reversed. there an answer for that? >> we've been tuck stuck in the la nina pattern for quite some time. that's starting to weaken. possibly better news for the summer, but it also could mean a return to hot weather. because we've had two cool summers. >> right. >> the past two summers. >> yes we have. >> kind of moderates itself overall. >> we'll see what happens. thanks, jeff. >> sure. >> and thank you so much for joining us. we hope to see you back here at 6:00. bye-bye.
